联合国人权事务高级专员办事处关于香港暴力问题的声明

联合国人权事务高级专员对香港特别行政区(香港特区)持续发生的事件及近日暴力升级的情况感到忧虑。

高级专员谴责任何形式的暴力或破坏财物的行为,并敦促参加示威的每一个人以和平方式表达意见。她注意到香港特首承诺要“广泛咨询”和“聆听香港市民的不满”。高级专员呼吁香港当局和民众进行公开和包容性的对话,以和平解决所有问题。创造渠道让民众参与公共事务和影响其生活的决策,是唯一能够确保达到长期政治稳定和公共安全的必要途径。自由表达意见、和平集会以及参与公共事务的权利在《世界人权宣言》中明文确认,也在《公民权利和政治权利国际公约》中列明,包含在《香港基本法》之内。

联合国人权高级专员办事处(人权高专办)已检视可靠证据证明香港执法人员使用非致命武器的方式违反了国际规范和标准。例如,执法人员向拥挤、封闭空间使用催泪气体,以及在多种场合向抗议者个体直接发射催泪弹,造成重大的死亡或严重受伤的风险。人权高专办敦促香港特区当局立即彻查这些事件,确保保安人员遵守使用武力的指引,并对执法人员对抗议者采取不符合国际标准做法的规则作出必要的修正。

人权高专办促请香港当局保持克制,确保和平表达意见人士的权利得到尊重和保障,同时确保执法人员对可能发生的任何暴力的行为反应适当,并符合国际上使用武力的标准,包括必要性和相称性的原则。
