王天成出狱不获户口身份证夺生存权

原北大讲师王天成向人大委员长李鹏投诉,因刑满出狱半年多警察不给他户口身份证,所以呼吁李鹏“还我生存的权利”,中国人权要求中国政府保障生存权,不要制造没有法律保护和法律地位的黑户人口。

中国人权从国内辗转获得向李鹏投诉的一封信,写信人是异议人士王天成。他是“中国自由民主党”的核心人物之一,并参与起草《中国自由工会倡议书》。94 年他们一案十多人遭到审判,是“六四”后对异议人士判刑最重最多的一次;其中,胡时根被判处 20 年徒刑,康玉春被判处 17 年徒刑,刘京生被判处 15 年徒刑,王天成也被判处了 5 年徒刑。1997 年 10 月 29 日,王天成刑满释放。王天成这次致函李鹏,是因为半年多来竭尽全力,找公安警察交涉,却始终不允许他依法登记户口,也不给他身份证。北京燕园派出所警察的理由是,要登记落户,必须有工作单位接受。但是在中国要找到工作单位,却首先要有户口和身份证。王天成向警察指出,释放证明书指定他到燕园派出所登记落户,中国法律没有规定落户必须先有工作单位,北京燕园派出所应该依法给他落户和身份证,警察对他的要求置之不理。警察甚至还告诉他,他们不给王天成登记户口,并没有国家政策或文件指示,而是几十年来他们就是这样做的。王天成要求警察写一个收据,证明收到过他的户口登记申请书,以及出具不予登记户口的书面材料,使他能够找上级部门解决问题,但被警察断然拒绝。半年来,王天成为办理户口和身份证,疲於奔命,但四处并壁。王天成在这封给李鹏的申诉信中说,目前他不仅没有户口、工作,不能外出谋生,还由於没有任何证件,随时可能被警察带走关押。所以,他要求李鹏敦促“有关单位依法办事,履行职责,立即为我登记户口,给我起码的生存、发展条件。”

中国人权要求中国政府立即解决王天成的户口和身份证,不要对异议人士横加刁难和陷害。没有户口和身份证,在中国不仅无法工作,不能自由走动和居住,甚至等於这个人就不存在。这不仅是生存权毫无保障,而且在法律意义上,也成了没有法律保护和法律地位的黑户人口。《中华人民共和国监狱法》第三十六条规定:“释放后,公安机关凭释放证明书办理户口登记。”王天成的释放证明书,指定他到“燕园派出所登记落户”,不允许他登记户口和发放身份证,是毫无道理并且违反法律的行为。过去也曾经有过如此迫害异议人士的事件,如刘晓波、刘刚就长期没有户口,刘晓波因此不能与未婚妻结婚,而刘刚最终被迫逃亡海外。中国人权呼吁中国政府尊重遵守法律,即使对异议人士,也不能破坏法律去施加迫害。
