Police at Zhongzhan Substation of Jiaozuo Public Security Bureau Unlawfully Restricted Lawyer Chang Weiping’s Personal Freedom and Violated His Right to Practice

In the morning of July 21, 2014, after lawyer Chang Weiping (常玮平) was denied a meeting at the Jiaozuo Detention Center with his clients Xu Youchen (许有臣) and Zhang Xiaoyu (张小玉), who were being held on suspicion of intentional homicide, he went to the Zhongzhan police substantion—which is handling the case—to go through the standard procedure to apply for a lawyer-client meeting. The police there pressed him to testify as a witness in the case, and Chang refused, in accordance to the “attorney-client privilege.” The standstill ended at 10:40 p.m. that day, when the substation issued a subpoena and forced Chang into interrogation for three and a half hours. In addition, the police copied all audio and video recordings from Chang’s mobile phone. They identified him as a “witness,” which rendered him ineligible to act as his clients’ defense attorney. Chang states in the essay that he will file a complaint against the Zhongzhan police substation for illegal detention and abuse of power. He also urges the ACLA to provide a clear explanation of “attorney-client privilege” and vows to take weiquan (rights defense) actions.


焦作中站公安分局违法限制常玮平律师人身自由侵害执业权利经过

  1. 2014年7月21日上午8:30分,本人作为张小玉涉嫌故意杀人案辩护律师,要求焦作市看守所安排会见。该所以需要办案机关同意为由,违法不予安排。
     
  2. 2014年7月21日上午11时许,本人赶到办案单位焦作市公安局中站分局递交委托手续并要求了解案件情况。一直等到约11时50分,袁姓警官等数人才接待了我。在核查完法定手续之外,又要求核实本人身份证以确定身份,我因未携带相约下午3点再来。
     
  3. 2014年7月21日下午3:30分许,我进入焦作市公安局中站分局。在再次准备递交委托手续之前,中站区警方向我下达《询问通知书》,声称“我局正在办理‘2014.7.17’焦作市中站区许有臣故意杀人案,为查明案件事实,依据刑诉法122条之规定,进行询问”,要求我提供对张小玉的证人证言。
     
    我以本人作为辩护人对当事人的保密义务与公民作证义务相冲突,为确定优先级别,需要聘请律师咨询并要求重新安排时间地点进行询问。后本人在征询本人律师朋友意见之后,明确告知本人不能以辩护人身份提供对当事人的任何证言,并拒绝以证人身份制作询问笔录。
     
    至当日晚间十点半之前,警方一直坚持公民作证义务优先,试图迫使本人改变决定,同时要求本人提供手机中自动存储的本人与张小玉的通话录音。我以我已明确表达了我的意思,多次要离开,但警方堵着门,坚决不让走。期间,在网上看到本人希望就近求助同行信息的河南张锦宏律师赶来对本人提供法律帮助,在匆忙一见之后即被警方分别强行带离。后本人明确表示,鉴于本人所聘律师无法保持在场,我再次要立即离开该局,被该局李姓警察和另一名便衣警察强行堵门,将本人推挡抱进询问室,并以歇斯底里的状态对律师进行指责,说我不尊重死者。
     
  4. 僵持到2014年7月21日晚间10点40分许,又变换花样向本人送达了焦中公(侦)传唤字[2014]0050号《传唤证》,以本人为“涉嫌故意杀人罪”的犯罪嫌疑人为由,传唤本人进行讯问,并对本人采取了强制措施。该传唤证载明的传唤时间是21日晚10时。于是,本人的身份又从“证人”神奇的变换为“犯罪嫌疑人”。随即,警察对本人进行了搜身,扣押了本人随身物品中包括手机在内的电子产品。随后的讯问内容显示,警方从本人手机中强行提取了案发前后本人与张小玉的通话录音。
     
  5. 2014年7月22日1时许至4时35分,警方对本人进行了讯问。内容围绕本人与张小玉的三次通话录音。本律师在此可以明确并负责任的讲,该三段录音,除第一段时间稍长是张小玉用普通话向本人陈述了她从北京到焦作以及彼时处境外,第二、第三段时间很短,主要是她用河南话在向他人喊话,我听不懂河南话,而且背景嘈杂,我当时感觉她深处危境,但不知详情,只是提醒她注意安全并保持克制,并无任何违法违规之处。该录音内容,本律师可以在适当时候(如征询当事人后)公布,以正视听。
     
  6. 2014年7月22日10时,警方的专业人员提取了本人手机中的全部音视频资料,40分钟后,警方口头向我宣布解除对我的传唤。至此,从21日晚间10点多将一个完全无反抗意图和举动的执业律师锁在审讯椅上已达12小时。从审讯椅上站起来的那一刻,我腰酸背痛,头晕目眩。焦作,领教了!此后约两个小时,警方迟迟不发还本人扣押物品,理由是扣押物品保管人尚在赶来警局途中。
     
  7. 2014年7月22日13时许,警方终于向本人发还了扣押的物品,并向本人提出,警方将本人在该案的身份确定为证人,因此不宜继续担任张小玉辩护人,并将向本人所在律所进行交涉。本人听到警方的口头宣布后,感觉犹如坐上了过山车,又从“犯罪嫌疑人”转回成了“证人”。
     
  8. 本律师认为:
    1. 询问证人是非强制程序,加之本律师有充足理由并始终坚持不做证人,焦作市公安局中站分局强行要求对本人询问时限制本人人身自由涉嫌非法拘禁,本人将依法进行控告。
    2. 警方若对该录音内容与本案是否关涉有疑问,可以向通信服务提供商调取。本律师无论是作为张小玉在今年三月委托的行政诉讼代理律师,还是因许有臣涉嫌故意杀人案作为所谓同案犯罪嫌疑人张小玉的辩护律师,接到张小玉的咨询电话非常正常,其内容依法应予保密。警方在未得到一丁点涉嫌犯罪证据之前擅自以本律师和张小玉有通话记录就将一个执业律师列为嫌疑人进行强制传唤,没有法律手续就强行提取本人手机中依法应予保密的通话记录等,涉嫌滥用职权。
    3. 本人请求全国律协对本案中律师的保密义务与公民作证义务的冲突适用做出明确解释,对辩护律师的执业权益受损、人格尊严人身权利被侵害立即启动维权程序。
