Update on Xie Yang (One of the Lawyers in 709 Crackdown)

In the below statement, Lawyer Liu Zhengqing tells of the process he had to go through to become Xie Yang’s legal representative and to meet with him in person. Liu writes of how Xie informed him about a number of things that happened while Xie was held under residential surveillance. For instance, after the review and prosecution stage of his case, every day the procuratorate sent six or seven prosecutors to take turns “chatting” with him. Xie said that he is engaging in a war of resistance against the authorities and must not give in. He also asked Liu to convey his heartfelt thanks to his friends and other members of society who had shown concern for him. 


谢阳案(709系列案之一)情况通报

(因近日很困未及时通报,特致歉!)

2016年12月6日上午9:10我到长沙市第二看守所办理会见谢阳手续,手续交值班人后,值班人一听说是会见谢阳便说要请示领导,并将我的律师证交领导审查,只一味地说要我等一等。结果我耐心等到下班仍无答复。12:10左右一干警说副所长要找我谈,并带我到二楼办公室与该副所长见面谈。该副所长说:因谢阳案已二个律师,一个是张重实,一个是蔺其磊,所以我现在不能见。我说你们不是不让蔺其磊律师介入吗?蔺其磊律师还没有进入程序,也没向你们递交手续,不存在有二个律师的问题。该副所长就顺坡下驴地说那你就让他家属解聘蔺其磊律师吧!并说如有什么问题可向驻所检察官反映。我想只要能让我介入,也就懒得纠结这样细节了。就对该副所长说没这个必要了,我要他家属写份解聘委托书给你们就是,于是我就走了。下午上班第一时间我就将谢阳的解聘手续交给值班人。值班人将解聘手续交领导处理。过了一会值班人给我看了一下《解聘书》,说是上面有谢阳确认解聘蔺其磊另行聘请我的签名,并说要我在2016年12月8日13:30来办理会见手续。(后来在会见谢阳时,谢阳说他当时就向看守所要求我马上会见,他们却说我已经走,谢阳向我确认有无此事。我说当时确实走了,但我给他们留有电话,如果他们有心让我马上见,他们完全可以给我电话,我要走也不会走很远的。)

我和谢阳妻及张重实律师到长沙市检察院案管中心要求复制案卷材料。值班人经请示后对我说“三天内答复你。”

2016年12月8日下午我和张重实律师会见了谢阳,谢阳告知其在监视居住期间的一些情况及进入审查起诉阶段后(含二次退补后案件又返检察院),检察院每天有6、7个检察官轮番地来陪他“聊天”。——因该情况之前已有披露,就不再重复了。谢阳说“此案是一个阻击战,如果我无原则地稀里糊涂地妥协了,下一步就还会有大批律师倒下,他们就会效法此方法来让那些敢言的律师屈服。”

最后,谢阳嘱我一定要代他向关心他的朋友及社会公众表达他的心声和谢意。谢阳对我说:“自由、民主、法制及尊重和保障每个人的基本权利是我毕生的追求,我愿意为此奋斗,为此承受的一切苦难均无怨无悔!请你转达我对社会各届及朋友的关心和支持表示由衷的谢意!并呼吁中国政府能够让此案得到公正的审理。”
