Family and Defender Urge Attention to Liu Jiacai’s Situation in Prison

Rights defender Liu Jiacai, currently serving his sentence in Hanjin Prison in Hubei Province, is frequently subjected to physical punishment and is taking psychotropic drugs to ease his mental pressure, according to fellow activist Li Wei.  At the request of Liu’s wife, Li has constructed an account of Liu’s daily routine based on information provided by a recently released inmate from the same prison that includes the following details:

  • inmates have to work nearly 12 hours every day;
  • if they don’t meet their production quota, inmates are made to stand for several hours after other inmates go to sleep at 10 p.m.;  
  • breakfast and dinner each consists of only a ladle of porridge;
  • failure to recite Rules of Conduct of Prisoners and other rules will result in studying overtime or the “standing” punishment; and
  • other inmates are ordered by prison police not to speak with Liu Jiacai.

Li Wei appeals for public attention to the treatment of prison inmates, particularly that of political dissidents and rights defenders, and for help in protecting their rights.

Liu was formally detained on August 12, 2013 on suspicion of “inciting subversion of state power," and was officially arrested on September 18 that year. He was convicted and sentenced to five years’ imprisonment on May 11, 2015.


刘家财在监狱服刑处境堪忧  呼吁关注

2016年8月12日接到正在服刑的湖北维权人士刘家财妻子王玉兰的电话,说:刘家财在监狱处境很不好,经常挨罚,压力很大,目前在服用精神类药物。会见时有警察站在旁边,有些话刘家财不便说。她让我与刘家财一名已经出狱的狱友联系了解详情。经多次联系后,终于与该湖北籍人士联系上了,听他讲了刘家财所在的湖北省汉津监狱和刘家财的处境等初步情况。改天再联系该刘家财的狱友进一步了解,电话就无法打通了。

刘家财因煽动颠覆国家政权罪于2015年5月8日被湖北省宜昌市中级人民法院判处有期徒刑5年,刑期至2018年8月11日。

以下是通过刘家财已经出狱的一名狱友了解到的情况:

一、监狱服刑人员作息时间

上午
5:45起床
7:00早饭
8:30-9:00出工

中午
12:00吃午饭,午饭时间20分钟
12:20出工

晚上
8:30-9:00收工
10:00 就寝

一天劳动时间几乎有12个小时。

二、服刑人员经常受到体罚和克扣口粮

汉津监狱服刑人员的主要劳动任务是缝制服装。制作服装是流水线作业,每名服刑人员负责不同的工序。

从入监队开始就需要出工劳动。

每名服刑人员每天都有劳动定额,完不成劳动任务的服刑人员会受到惩罚。惩罚手段之一:晚上10点其他服刑人员就寝后需要站几个小时才能睡觉。惩罚手段之二:早餐和晚餐只发一小饭勺稀饭吃。

以下是我与刘家财的狱友的问答。问话者是笔者,回答者是刘家财一名已经出狱的湖北籍狱友。

:“你们劳动时间那么长的原因是什么?季节性的还是长期如此?”
:“长期如此。监狱为了创收啊。”

:“司法部不是规定收支两条线吗?”
:“上有政策,下有对策。天高皇帝远。沙洋农场在当地(黑暗)是出名的。过去有‘(狱警)自行车比汽车跑得快……’的歌谣。”

三、监狱其它方面对服刑人员的严苛管理

1、新犯入监先进入监队2个月。规定时间背不会《服刑人员行为规范》的服刑人员,此后每天需要晚上加班学习到第二天凌晨1点-2点才能睡觉。

2、背完《服刑人员行为规范》后,还需要背《弟子规》,如果在规定的时间内背不会,还需要天天晚上罚站。

3、劳动时,如需要上厕所,需要向管教干部(狱警)报告,经同意才能去。去上厕所需要一路小跑,回来后要向干部报告:“谢谢干部教育。”

该狱友说:入监时,他和刘家财在同一个入监队两个月,后来分到不同监区了。在监狱,虽然干部表面上对刘家财很客气,但背地里狠着呢。干部不允许其他犯人和刘家财说话,说他是反革命政治犯。谁和他说话谁就要受处罚。

一些良心犯在服刑期间都会遇到与刘家财类似的处境,虽然监狱法明确禁止体罚或虐待服刑人员,但是向检察院控告往往得不到支持,起诉到法院,法院往往以服刑为刑事诉讼法授权的行为为由不予立案。

刘家财简介

刘家财,男,1965年10月26日出生,原系葛洲坝集团职工。1998年至2000年期间,由于某种原因,葛洲坝下岗职工合法权利受到非法侵害及葛洲坝企业可能存在某种严重问题,刘家财为数千下岗职工讨要工资、为职工子女争取教育经费维权,嗣后在困难环境下为争取维权成功,依宪、依法组织独立工会接受一些媒体采访,因此被湖北省宜昌市司法当局于2001年以煽动颠覆国家政权罪判处管制两年,剥夺政治权利两年。

刘家财出狱后,当地国保对其长期监控骚扰,甚至刘家财因此丢了工作,但刘家财多年来并未因长期遭受非法对待及承受的巨大压力而放弃公民权利,继续通过各种方式,依法、理性、平和、坚定为公民权利、自由、民主、法治、人权鼓与呼为良心犯声援,参与许多具体维权工作。

2013年8月2日刘家财因在网路上转发山东维权律师李向阳的《复仇血洗公告并招募敢死队员》而被员警带走,第二天被宜昌市公安局伍家岗区分局以“虚构事实扰乱公共秩序”行政拘留10天,关押在宜昌市拘留所。

2013年8月12日刘家财被以“涉嫌煽动颠覆国家政权罪”刑事拘留,同年9月18日被湖北省宜昌市伍家岗区检察院批准逮捕。2013年11月21日,宜昌市检察院以“涉嫌煽动颠覆国家政权罪”向宜昌市中级法院提交起诉。2014年7月23日宜昌市中级法院对刘家财“涉嫌煽动颠覆国家政权”进行开庭审理。2015年5月11日湖北省宜昌市中级人民法院以“煽动颠覆国家政权罪”判处刘家财有期徒刑5年。2015年12月2日湖北省高院裁定驳回刘家财的上诉,维持原判。
