Chen Qitang Meets Lawyer for the First Time

On June 10, 2015, lawyer Liu Xiaoyuan met with activists Chen Qitang (penname: Tian Li) and Su Changlan at the Nanhai Detention Center in Foshan City, Guangdong Province. This is the first time Chen Qitang has been allowed to meet with a lawyer since his initial arrest on November 25, 2014. According to Lawyer Liu, Chen was still very optimistic, insisted that he is not guilty of “inciting subversion of state power,” and said he had filed a complaint with the procuratorate against the Nanhai branch of the Public Security Bureau regarding its investigation of him for “endangering state security.” Liu reports that Su Changlan’s health is still poor and she has many ailments, but is not receiving any treatment at the detention center, which claims that its medical resources are limited.


晓原律師帖:2015年6月10日,我在佛山已呆了两天,今天下午三时,南海看守所才安排我在3号会见室会见了陈启棠。这是陈启棠自去年11月25日被抓后,第一次会见律师。

     案件在侦查阶段时,我多次申请会见都不允许。陈启棠还是那么乐观,一开口就嘻嘻笑。他坚持认为不涉嫌什么煽颠覆国家政权犯罪。他说,在逮捕前,警察要他写保证书,说不要死扛了,可以放他一马。天理说只保证不去参与社会维权活动,警方也没要他的。他说,被抓的起因,是去年11月25日与苏昌兰丈夫一起,去见了一个曾和苏昌兰同关在看守所的女士,警方监听了电话,以为苏昌兰要他毁灭什么证据。把他抓了后,则以他写的文章指控涉嫌寻衅滋事犯罪。针对南海分局立案侦办危害国家安全案件,他在里面向检察院写了控告信。

       在我进入会见室前,不允许带公文包和手机,警察用手持安检仪对我搜身,还坐在走廊监视,提出抗议也无用,会见时间半个小时。天理从监仓出来,走到会见室,与其他羁押人员一样戴了黑头套。

      下午,我会见完陈启棠(天理)后,接着安排我会见苏昌兰。在办理登记时,我向办事大厅警察提出,会见天理这间会见室墙上电扇不能转动,只对着里面吹,热得我衬衣全湿透。我要求换间会见室,警察称其他会见室也是这样。我说,你们也不会换的,这间会见室里肯定装有录音设备,会见室桌子抽屉拉不开。警察说,那就换一间吧,给了我另一间会见室牌子。从办事大厅进入会见室后,里面警察又把我带到了刚才会见天理的那间会见室。

     苏昌兰说,5月27日会见她后,回到监仓被同仓羁押人员搜身,担心律师给她传递信件。她提出抗议,同仓人员说是管教叫她搜的。管教来了,又亲自搜身,还搜查苏昌兰监仓里的衣服和食品,搜走了她写的家信底稿、取保候审申请书、案件进展情况等材料。每次会见完回到监仓,管教要问与律师说了什么?管教告诉她,你与律师会见谈了什么,会见室里有录音录像的。

       这正如我所预料,昨天我突然来会见,不给及时安排就是因为来不及在会见室安放监听设备。

      在安排我会见前,有一个女律师排在我前面,她看到先安排我会见,向警察提出异议。警察解释说我是昨天预约的,女律师很是惊讶,说会见还要预约呀,不是来了就可安排会见吗?我向她解释是故意刁难我,让我多呆两天,也是为了安装录音设备。

      苏昌兰身体仍然不好,因患有甲亢,而引起心脏间歇停頓症,颈椎病严重,手脚麻木疼痛。看守所以医疗条件有限为由,劝她忍着些。苏昌兰很担心家里,她丈夫陈德权前些年车祸伤残,行动不很方便。当她知道儿子今年高考成绩还好时,她露出了一点笑容。这次,会见近40分钟。

     会见完后,我向看守所作了投诉。
